THE PROBLEM

The client was an agency worker with complex health issues who had nevertheless remained able to continue in employment. She contacted us because her employer had terminated her employment after a period of sick leave. Her employer had contributed to her ill health by placing her in an unsuitable work environment and failing to make reasonable adjustments for her disability. She was not a trade union member and had no access to any other source of support.  

WHAT WE DID 

We advised her that she had a case for disability discrimination under the Equality Act as well as for unfair dismissal and submitted an application on her behalf to the Employment Tribunal. We supported her with her case through to Judicial Mediation conducted by a Tribunal judge, where we represented her together with an employment barrister.

THE RESULTS

We were successful in securing a compromise settlement of £16,500 from the Respondent for unfair dismissal and disability discrimination.
